We recently represented the Seventh and Eighth Respondents in a lengthy trial in the Federal Court of Australia, Victoria Registry and achieved a great result.
The important and timely decision clarifies the law around:
1. accessorial liability for employees and contractors in respect of misleading or deceptive conduct; and
2. the limits of a franchisee’s ability to rely upon representations as to future matters.
The case has now been reported in the Australian Law Reports ((2020) 381 ALR 668) and Australian Trade Practices Reports ((2020 ATPR 42-682).
